When the project was abandonded, the State enacted a law which swept all unspent fees into the State general fund. Successfully challenged the constitutionality of the sweep, resulting in what many consider one of the most important decisions in the recent history of the Nevada Supreme Court. This decision prevented the sweep and secured the refund of a substantial portion of the fees paid by each client

Successfully represented a Homebuilder Association in challenging an ordinance which created procedures that required supermajority approval by the Clark County Board of County Commissioners of zone changes that did not conform to the adopted master plan. Clark County and various other citizens and citizen groups filed an action in the Clark County District Court seeking a declaration that the ordinance was valid. Homebuilders Association filed a counterclaim. The District Court granted summary judgment in favor of Clark County. On appeal, the Supreme Court of Nevada reversed the District Court and held that the super majority requirement in the ordinance violated Nevada law and was, therefore, invalid
